The sc has stayed important provision sec 3(c) of Waqf amendment act,2025. Firstly the amendment act was itself was incomplete and a little relief which was given by the legislation pertaining to govt properties has also been stayed. The sc has trangressed its powers by staying the statute and this order is discriminatory. On waqf issue i do not agree either by the amendment (completely) or by the sc order. There was no hearing on waqf act, 1995.

Key provisions of Waqf bill stayed

There are some caveats in the order as per this report. The court said the provision in Section 3(1)(r) that a person has to be practising Muslim for five years to create a waqf “shall remain stayed till rules are framed by the state for providing a mechanism for determining the question as to whether a person has been practising Islam for at least 5 years or not.” . Sec 3(1)(r) has been stayed till Rules are made out by the states. This would most likely to lead a situaition; where BJP strong hold states will bring in a stringent rule to prove one-self a Muslim to donate property to Waqf, where as "secular" states like Kerala would water down the rules and make that even a person drunk & sitting in a bar can just make a statement that he is a Muslim and that is valid proof.

On the reduction of collector's powers to determine the right over property the ruling is that "Unless the issue regarding the title to the Waqf property is not finally decided, no third-party rights can be created against any third party in respect of such properties ". So looks like the SC is batting for another court or tribunal which would be the final deciding authority and not the district collector. The way out for the government would be designate any civil court the power to hear appeals on the decrees from the Waqf Tribunal. Also note that the stay order also says that "no third party rights can be created" which means that the Waqf trust also would not be able alieante the property or allow third parties to claim any rights on the Waqf property when the enquiry is pending.

Also note; Provisions against Waqf by use has not been stayed. SC agreed with the contention of the government that this tactic was used to encroach on government lands. Also now Waqf board also has to follow the rules in the Limitation Act which sets a limit by when a suit to claim a property as Waqf has to be filed in a court. And also this stay is an interim stay. The hearings are not completed and the final decree is yet to be made.

1. Partial Interim Stay on Specific Provisions, Not the Entire Act

By allowing most provisions to stand, SC has signalled confidence in Govt's broader vision to streamline and modernize Waqf management, ensuring it serves public interest. Big Blow to Land Jih@dis.

2. Stay on 5-Year I$£am Practitioner Requirement for Creating a Waqf

It appears to be a big blow to Modi Sarkar, but you need to read ahead how SC has played with Land Jih@dis.

5-YEAR PROVISION STAYED ONLY UNTIL STATE GOVERNMENTS FORMULATE RULES.

So NDA rules States are free to form their own rules, which will definitely align again with Modi Sarkar's Waqf Amendment Act & Land Jih@dis don't even get a chance to cry. About CHINDI ruled States? Let people decide which Govt they want. A NDA Govt that will SAVE their hard-earned & ancestral properties or a CHINDI Govt that will GIFT them away to Land Jih@dis.

3. Stay on the Power of the Collector.

Again seems to be setback, but good in the long run. Instead of concentrating power in the hands of Collector, matter is to be referred to the tribunal. It may become time-consuming, but those who know the power of CONgress formed ecosystem will understand how dangerous it would have been. What if CHINDIs come to power in a State? Every Govt appoints its 'trustworthy' bureaucrats in powerful positions & then you know what decision 'SUCH' Collector will deliver. SC has eliminated this possibility.

4. Not More Than 3 Non-Mu$£ims in Waqf Board

The court's ruling to limit non-Muslim representation to no more than three members on Waqf Boards strikes a balance between inclusivity and respect for community-led management while ensuring that Boards remain representative yet open to broader perspectives, diluting the influence of any extremist factions seeking to monopolize control. And...popcorns won't tell you that SC HAS NOT PUT ANY STAY ON NON-MU$£IMS BEING WAQF CEO. So indirectly, Govt still holds control on the Waqf Board.

So overall, I don't find any reason to get disappointed with today's verdict which has actually given guarantee that WAQF AMENDMENT ACT WILL STAY CONSTITUTIONALLY VALID. The hardcore I$£amists are running into a big trouble & Land Jih@d is finally heading to extinction.

If humanities are such important subjects, the government would be better off by opening Indian Institute of Humanities rather than opening them under the label of IITs. Isn't manufacturing that is actually 2 nm? Does chips specifically need to be designed to enable them to use 2nm manufacturing? Do EDA tools also have to be specifically developed to design chips at a particular node?

All these companies like qualcomm, arm, apple have chip design centers in India. EDA tool makers like synopsis and cadence also have development centers in India. What sort of work is done in their India offices? Is it just grunt work or at least some advanced work is done? On a scale of 1 to 10, 10 being the most advanced stuff probably done in the US (or uk for ARM), what level is done in India? At least a 7 perhaps. Can we scale up to 10? Can Indian engineers working in these offshore sites develop matching software and hardware on their own if push comes to shove?

I know china has been trying to develop their own EDA tools without much success a few years back. Don't know what the situation is now.

LAM research which develops etching tools has a design center in India. Again grunt work or cutting edge?

We should have had atleast 24nm DUV lithograpgic machines by now. But then even Japanese don't have them.
